Abstract: Whether we recognize it or not, the Internet is full of exciting and original institutional forms that are transforming social organization on and offline. Governance issues in these Internet platforms and other digital institutions have posed a challenge for software engineers, many of whom are not exposed to the pertinent history or theory of institutional design. This paper provides a useful framework that aims to promote dialog between computer scientists and political scientists. The most prevalent guiding principles for the design of digital institutions to date in human-computer interaction, computer-supported cooperative work and the entire tech industry have been an incentive-driven behavioral engineering paradigm, which is a collection of atheoretical methods such as A/B-testing and incremental software engineering driven by issues. minecraft pixelspark servers One of the institutional analysis frameworks that has proved useful in the design of traditional institutions is the resource governance literature , also known as the "Ostrom Workshop". One of the major conclusions of this literature that has yet to be fully integrated into the design of numerous new institutions is the importance of incorporating participatory processes in what is referred to as the "constitutional" layer of institutional design. This is essentially defining rules that allow for and facilitate the participation of diverse stakeholder groups in institutional design changes. We explore to what extent this principle is being fulfilled or could be better fulfilled in three different instances of digital institutions: cryptocurrencies, cannabis informatics, and amateur Minecraft server governance. We can illustrate the significance of constitutional layers in various types of digital institutions by looking at such diverse cases.
